The justification for not providing due process to the deportees is that step is unnecessary under the authority given to the prez by the AEA. What the intel agencies are saying is invoking the AEA is illegal because circumstances do not warrant it.

It's a reasonable legal argument to make it's one of the reasons we have the courts. The biggest problem I have with granting all these people due process "rights" is that it's exceedingly easy to overwhelm the system which allows the people who are objectively breaking the law to get what they want which is to stay in the US. It's why the remain in Mexico policy was so effective.
