Thanks for posting that Court filing of the Aziz brothers! That kind of shit is utterly disgusting and hopefully ALL the parties involved in the alleged illegal activity will pay a penalty, including Trump for the unlawful initiation of that EO before publication of it and all that entails!

I suspect more to this story. The exec order shouldn't legally have any effect on someone who already has a visa.

But they must be of the same class! If one class is separated from another class as in Section 5(b) of the EO on the basis of religion it runs afoul of the Establishment clause of Amendment I along with the Due Process clause and the Equal protection clause of Amendment V. There is more to it that just those three on the surface, but that's enough to make the point that the law was not being followed as you claimed!

Here is the Section from the unnumbered, unpublished and non-archived EO (more issues with the law there, but that's for later);

"Upon the resumption of USRAP admissions, the Secretary of State, in consultation with the Secretary of Homeland Security, is further directed to make changes, to the extent permitted by law, to prioritize refugee claims made by individuals on the basis of religious-based persecution, provided that the religion of the individual is a minority religion in the individual's country of nationality. Where necessary and appropriate, the Secretaries of State and Homeland Security shall recommend legislation to the President that would assist with such prioritization."
