I believe the Individual Mandate is Unconstitutional Whether you call it a tax, or a Fee.
The Government is now arguing it is a Tax Because they know as a fee it would violate the constitution.
However under a literal Interpretation of the Constitution Congress shall only levy taxes to Raise Revenues.
If the Mandate is a tax, it is not a tax set up solely to Raise revenue, or even mainly to. It is a tool to effect behavior, and that is not constitution.
And yes I know the Government has used taxes in the past to try and effect behavior. It was unconstitutional those times as well. IMO
