Actually, it doesn't just "clears people off of the voter rolls who have stopped voting." If that were all it did, the court would have ruled differently. At question in the case appears to be a clause in the NVRA which says that states cannot remove someone from voting rolls on change-of-residence grounds if failure to vote is the sole reason. The majority held that is is acceptable for states to use non-voting as a reason to send out return cards asking voters to confirm their residence; failure to return such notice combined with failure to vote in the next 2 federal general elections leading to removal from voter rolls.

Certainly if someone dies they will neither return the notice nor vote in the specified time period, but the ruling does not worry about whether the voter in question is dead, or has moved, or simply fails to respond. It is about whether the system as implemented violates the NVRA.

I can't speak to the intent of the law in question.
