Agreed. However there is a precedent. Lincoln used Article 1 sections 8 and 9 to suspend civil governance and habeus corpus respectively on the eve of the Civil War.
Constitutionally habeus corpus is the only right that may be suspended in an insurrection. This ain't the 1860s, the people won't put up with that kind of BS now, I don't think SCOTUS would either. And there's no insurrection.
