and my feeling is we shouldn't be changing the subject when the real issue is being mandated to have a vaginal probe by the state.
Yes, but the subject must be changed by those who know theyll lose the debate concerning the real issue.
This seems to be just normal healthy practice. There is no such thing as a vaginal ultrasound probe that I am aware of and it is not mandated here.
As already noted, it is mandated to the extent a fetal image must be obtained 24 hours prior to the abortion, often not possible with the non-invasive procedure:
In its current form, Virginias bill requires that the ultrasound find and monitor the fetal heartbeat and provide an image of the shape of the fetus. As in other states with ultrasound laws, this will often require a probe to be inserted into the vagina. The nonintrusive abdominal ultrasound, on the other hand, often cannot capture the fetus at its small size in the first trimester, when most abortions are performed.

To obtain the image required by law, an invasive, transvaginal ultrasound will be required. The measure doesnt need to have the actual words transvaginal ultrasound to mandate the procedure.
The invasive transvaginal ultrasound clearly manifests an undue burden per Casey, and is consequently un-Constitutional.
