SO you believe that 'someone or anyone' can just take their case directly to the SCOTUS ?

The SCOTUS votes on which PREVIOUSLY DECIDED cases they want to accept.

Typically, the Court hears cases that have been decided in either an appropriate U.S. Court of Appeals or the highest Court in a given state(if the state court decided a Constitutional issue). The Supreme Court has its own set of rules. According to these rules, four of the nine Justices must vote to accept a case.

The Sentences are based upon Sentencing Guidelines. The Judge has to sentence within the guidelines, and if he goes outside of them has to explain in writing for the sentence to be reviewed by the court of appeals.

Now I admit that is a fairly convoluted way of going about it. But it was created when Republicans wanted to stop Liberal Judges from giving Criminals a slap on the wrist for some sob story about how they were abused as children.

Republicans demanded we get tough on crime. This is the result. There isn’t much leeway for the Judge. He has to sentence within the guidelines or have the sentence reviewed and often overturned by the Court of Appeals.

That is professionally embarrassing and affects the Judges standing for any future higher court appointment.

This is the Court System the Republicans wanted. They passed the laws to get tough on crime. They passed the guideline system to insure Leftist Judges didn’t let Rapists and Murderers out with a slap on the wrist.

The Koch brothers literally supported Trump for President in 2020 simply because of the Supreme Court pick the Senate had denied Obama.
