You'd be surprised Daniel, in normal western nations, like the USA and all of the EU, you don't have to be a citizen or of a particular religion to own land. modern International law has nothing to do with it.
In Israel non-Jews are prevented from leasing most of the available land. They have access only to privately owned land, about 7% of the total.
Israel is the only country claiming to be a democratic, advanced-economy country where state or quasi-state agencies own the vast majority of the land area. An estimated 93 percent of the country’s total land area (excluding the occupied areas of the West Bank and Gaza) is owned by the state or by quasi-state agencies. Non-Jews are not entitled to lease Jewish National Fund land and the Jewish National Fund owns the land in concert with the state. This state-owned land can only be leased anyway, it is never sold.
"While there is no legislative mandate prescribing the objectives the ILA must advance, these have been established through judicial precedent. A seminal ruling dictating these objectives can be found in the Israel Supreme Court case of Adal Ka’adan v. the Israel Land Administration:
“…The objectives that comprise the core authority of the Israel Land Administration are the continuation of State control of Israeli Land and the perpetuation of the administration and development of land in Israel under the concentration of a singular government entity. This is to prevent the transfer of ownership to non-favorable entities, to advance security issues and to authorize the operation of different national projects – such as: the absorption of new immigrants, the proper distribution of the population and agricultural settlement…”
"In principle, land that is owned by the Jewish National Fund can be leased to Jews only. The implication is that foreigners, as well as Israeli citizens and/or residents who are not Jewish, are not entitled to lease this land."

Having Palestinians owning land is completely unlawful due to the fact they can't be owners of this land by modern international law since they were not born in Israel (difference of religion doesn't matters here), next.I believe it's because they never intend to recognize Israel, not at the current borders and not in any borders.
The current borders reflect to any other borders as well, how so?
If they do not wish to declare statehood starting off with Gaza (which clearly has a wider borders than its actual borders) and declaring independence could ease the process of future borders, in other words the borders are not the issue here - but the recognition in Israel that would be forced upon declaring statehood and borders - UNLESS - they never intend to recognize Israel which means they simply want it all.
Which is why they refuse to recognize Israel as a Jewish State. If the Arabs had won the 67 War do you think the Pro Palestinian Kool Aid Drinkers would be screaming about " occupation?" Ask why Israel should give In to all demands and there will be no response.
The reason that the Christians and Muslims should not be living under Jewish rule is because they were the people that were living there before the Europeans colonized the place.
