Possible partisan battles in Senate over Trump impeachment trial previewed

"WASHINGTON (Reuters) - U.S. Senate Majority Leader Mitch McConnell on Tuesday raised the possibility of a spirited battle over how an impeachment trial for President Donald Trump would be run and suggested that the referee - Supreme Court Justice John Roberts - not meddle."

Moscow Mitch will be dealing with Trump's impeachment/removal in an election year. I wonder if that will affect which witnesses we will be allowed to hear from? Will Rudy and Don and Mick get an opportunity to provide some first-hand information on this matter?
At the hearings I've been part of, the Judge is a critical member of the proceeding. At least for one, the judge will shut down a lot of the repetitive badgering and grandstanding that we heard during the House impeachment hearings. "Asked and answered; move on" is a good one.
They also sustain or deny objections on points of law, allowing or omitting certain testimony, which can be critical. They can question witnesses if the attorneys fail to raise important points. Judges do a lot of things besides listen. And Chief Justice Roberts is not going to put up with a bunch of bullshit from either side if they try to tell him how to run the trial. I think he might have a little more experience with that than a bunch of Senators who think they know everything.

The first thing he will break of the House Managers heads are the hearsay evidence they will try to introduce. The Dems will be left without a case, which they never had to begin with!
What hearsay?

There is nothing but hearsay. Only two people were on the call and BOTH said nothing improper happened. You Communists have offered NOTHING but slander, libel, innuendo and third hand accounts. PLUS this whole thing is based on a fabricated tale by Eric Ciaramella who is the CIA goon that worked with Alexandra Chalupa in getting Ukraine to interfere in the 2016 election.

Damned right Ciaramella will be called by the Senate.
Only two people were on the call and BOTH said nothing improper happened

Liar.

To get people, the voters, to believe this about Biden.....

The mere suggestion has you dopes hooked. Bigly.
Biden is on video admitting he pressured the Ukraine to back off from looking into Burisma

That is not what Biden did, dope.

It's that very narrative that it was done for corrupt purposes that is the benefit to Trump campaign. You dopes swallowed it whole at the first suggestion. Now Trump has an army of dishonest losers like yourself who continue to propogate this lie at every opportunity.

That's exactly what Biden did, he admitted on tape, and the former prosecutor backs up the story with his own words, DOPE.

No, dope.
He pressured the Ukrainians to sack their corrupt attorney general. There was no investigation into Burisma at the time.

Fucking liar.

He BLACKMAILED Ukraine into firing the prosecutor investigating his son who was acting as a MULE in a kickback scheme from Burisma that Quid Pro Joe was embezzling millions in US foreign aid through. Chris Heinz, step son of John Fucking Kerry was a mule collecting kickbacks for Lerch as well. democrats, the whole fucking lot of them are crooks. The entire embezzlement scheme was set up by Hillary.
Post it, liar.
There was no investigation at the time of the firing.

How the FUCK did Lying Schitt get the PHONE RECORDS of the President's personal lawyer and a US Congressman?

Why the FUCK is this crook bastard Schitt not in CUSTODY? This is the MOST OUTRAGEOUS abuse of power and infringement of 4th Amendment rights I've ever seen. PLUS the CROOKED LITTLE FUCK has the phone records of journalist John Solomon? What happened to the 1st Amendment, you fucking traitor bastards?

THIS is the kind of shit you take up arms over. WE HAVE NO FUCKING LAW, Adam Schitt is a scumbag dictator constrained by no law or Constitution.

William Barr, ENFORCE THE FUCKING LAW, or by god we the people will. Arrest this SCHITT now.

Nice meltdown and dodge.

Nice treason, scumbag.

Still melting down I see.

What's Rudy doing? Who's he doing it for?

So, Adam the lying Schitt violated the 4th Amendment and abused power. You're good with that though, you ONLY care about power for your filthy and corrupt party.

Still melting down and dodging. Good for you.

How did Stalinist Schiff get those phone records??

He committed felonies and violated the 4th Amendment, but he is a democrat, so laws don't apply to him.

It's the country we live it, laws don't apply to democrats. We have allowed this for decades. We get those like Bill Barr who say "We will have equal justice and hold democrats to the law," but they never do it.

IF we want a nation of laws, then we the people will need to rise up and force the issue.

Nunes can’t “recall” talking to Lev Parnas despite multiple call logs

"Rep. Devin Nunes, R-Calif., said during a Fox News interview that he could not 'recall' speaking with Lev Parnas, an indicted associate of Trump attorney Rudy Giuliani, despite call records released in the House Intelligence Committee’s impeachment report showing numerous phone conversations between the two.

"Call logs that apparently obtained from AT&T and included in the endnotes of the report show at least four calls between Parnas and Nunes on April 12, amid the smear campaign against then-Ukraine Ambassador Marie Yovanovitch.

"Parnas also called The Hill columnist John Solomon, who pushed the false narrative against Yovanovitch at the outlet.

"The logs also show that Nunes spoke multiple times with Giuliani ahead of those calls.

"Parnas, who was a key player in Giuliani’s search for damaging information on former Vice President Joe Biden in Ukraine, was later indicted on campaign finance charges."
how do you know he talked to the guy? what court approved looking into his phone records? or finding out who he called? unless you have transcripts, you got nothing again son. I think it's now time to arrest Schitt's for abuse of power.

Let's ask Gordon:

“I Do Hate What He Is Doing”: Adam Schiff on Trump, Impeachment, and What’s Next

During the House Intelligence Committee hearings, Republican members listened when Gordon Sondland, a lifelong Republican who is Trump’s own appointee as the Ambassador to the European Union, told the panel that Trump had refused to meet with Zelensky unless he agreed to the investigations that Trump wanted. 'Was there a quid pro quo?' Sondland said. 'The answer is yes.'
trump-impeachment-notes-01.jpg

"Nonetheless, Republicans then went on television and claimed that Sondland had said no such thing, simply ignoring that portion of his testimony."

Are they all lying to protect the pathological liar-in-chief?

Report | Permanent Select Committee on Intelligence

"By the time Ukrainian officials were first learning about an issue with the anticipated military assistance, the President’s hand-picked representatives to Ukraine had already informed their Ukrainian counterparts that President Zelensky’s coveted White House meeting would only happen after Ukraine committed to pursuing the two political investigations that President Trump and Mr. Giuliani demanded.

"Ambassador Sondland was unequivocal in describing this conditionality, testifying, 'I know that members of this committee frequently frame these complicated issues in the form of a simple question: Was there a quid pro quo? As I testified previously with regard to the requested White House call and the White House meeting, the answer is yes.'

"Ambassadors Sondland and Volker worked to obtain the necessary assurance from President Zelensky that he would personally commit to initiate the investigations in order to secure both."

As expected, Trump will not challenge the evidence against him.

The Post writes, "Pat A. Cipollone, the White House counsel, indicated to the House Judiciary Committee on Friday that Trump would not be sending attorneys to its hearing on Monday, when the panel charged with drafting articles of impeachment will hear evidence from Intelligence Committee lawyers on the investigation into the president’s conduct toward Ukraine.

"The scathing, two-paragraph letter reiterated the White House’s protests that the Democrats’ impeachment investigation violated Trump’s due process rights. Cipollone did not explicitly say the White House would not participate in the House process going forward, but gave no indication that it would."

The letter is typically Trumpian. Trump makes accusations, but never explains them. In this case, the White House has made the claim that the "impeachment investigation violated Trump’s due process rights," but the two paragraph letter does not explain how the impeachment investigation is violating Trump's due process. In the case of the Judiciary Committee, they have invited Trump's lawyers and his witnesses. Schiff did the same in the open hearings of the Intelligence Committee. In both cases, Trump has refused then he turns around and says he is being denied due process while calling the Constitutionally mandated impeachment proceedings a hoax.

Trump is relying on lies and attempted deception. Those are the actions of a very guilty President.

This is why Democrats are so eager to impeach Trump. As you will see, so should Republicans.

“I would like you to do us a favor, though.”

This is from the transcript of the July 25 phone call between Trump and Zelensky. It was provided by the White House. The following is a quote from Trump.

Good because I· heard you had a prosecutor who· was very good and he was shut down and that's really unfair. A lot of people are talking about that, the way they shut your very good prosecutor down and you had some very bad people involved. Mr. Giuliani is a highly respected man. He was the mayor of New York City, a great mayor, and I would like him to call you. I will ask him to call you along with the Attorney General. Rudy very much knows what's happening and he is a very capable guy. If you could speak to him that would be great. The former ambassador from the United States,· the woman., was bad news and the people she was dealing with in.the Ukraine.were bad news so I just want to let you know that. The other thing, there's a lot of.talk about Biden's son, that Biden stopped the prosecution and a lot of people want to find out about that so whatever you can do with the Attorney General would be great.Biden went around bragging that he stopped the prosecution so if you can look into it ... It sounds horrible to me.

“What you’re describing is a quid pro quo,” asserted the reporter. “We do that all the time,” replied [Trump's chief of staff] Mulvaney. “Did he also mention to me the corruption related to the DNC server? Absolutely. No question about it. But that’s it. That’s why we held up the money … I have news for everybody: Get over it. There’s going to be political influence in foreign policy.” ‘We Do That All the Time, Get Over It.’ Mulvaney Boasts About Ukraine Plot

After the July 25 phone call with Zelensky, as he usually does, Trump doubled down on the Biden investigation. On Oct. 3, in a news conference on the White House lawn, he called on Ukraine and China to look into former Vice President Joe Biden and his son Hunter.

“If they were honest about it, they would start a major investigation into the Bidens,” Trump said when asked what he wanted Ukraine President Volodymyr Zelensky to do about the former veep and his son.

“They should investigate the Bidens,” Trump said. “Likewise, China should start an investigation into the Bidens, because what happened in China is just about as bad as what happened with Ukraine.”

Trump says China should investigate the Bidens, doubles down on Ukraine probe

There is no getting around it. It is all well and good that Republicans can say Trump did nothing to cause his removal from office, but if the Republicans in the Senate exonerate Trump, if Trump's fans continue to insist impeachment is a sham, then the Republican Party and Trump's fans are saying:

A) The President is permitted to ask for foreign interference in our elections to improve his chances of winning.

B) The President is permitted to use military aid approved by Congress to a country fighting Russian aggression as a means of extortion to compel a foreign leader to comply with his wishes.

C) To cover up his deeds, the President is permitted to use obstruction of justice.

D) The President is permitted to ignore Congressional oversight as mandated by our Constitution.

Is this what the Republican Party wants to be remember for?

How did Stalinist Schiff get those phone records??

He committed felonies and violated the 4th Amendment, but he is a democrat, so laws don't apply to him.

IF we want a nation of laws, then we the people will need to rise up and force the issue.

Stalinists like colfax_m depend on big lie techniques. He tells an outrageous lie and then repeats it, thinking we will believe it because no one would be so sleazy as to tell a lie of that magnitude. Problem is though, ALL democrats are that sleazy. The democrats are a party of sociopaths and degenerates.

{
Fanatics can justify any action, and House Intelligence Chairman Adam Schiff this week demonstrated where that mindset leads. In his rush to paint Donald Trump as a lawbreaker, Mr. Schiff has himself trampled law and responsibility.

That’s the bottom line in Mr. Schiff’s stunning decision to subpoena the phone records of Rudy Giuliani and others. Mr. Schiff divulged the phone logs this week in his Ukraine report, thereby revealing details about the communications of Trump attorneys Jay Sekulow and Mr. Giuliani, ranking Intelligence Committee member Devin Nunes, reporter John Solomon and others. The media is treating this as a victory, when it is a disgraceful breach of ethical and legal propriety.

If nothing else, Mr. Schiff claims the ignominious distinction of being the first congressman to use his official powers to spy on a fellow member and publish the details. His report also means open season on members of the press. Mr. Giuliani over months has likely spoken to dozens of political figures and reporters—and the numbers, dates and length of those calls are now in Democrats’ hot little hands. Who gets the Schiff treatment next}

Smith v Maryland. Read it. Get back to me because you won’t believe it if it comes from me. You have to find out yourself.

Here, because I’m generous, a link and a quote.

No. Justice Harry A. Blackmun delivered the opinion for the 5-3 majority. The Court held that Fourth Amendment protections are only relevant if the individual believes that the government has infringed on the individual's reasonable expectation of privacy. This reasonable expectation of privacy does not apply to the numbers recorded by a pen register because those numbers are used in the regular conduct of the phone company's business, a fact of which individuals are aware. Because the Fourth Amendment does not apply to information that is voluntarily given to third parties, the telephone numbers that are regularly and voluntarily provided to telephone companies by their customers do not gain Fourth Amendment protections.
