Why should anyone lose their rights for being romantic?

Anthony Brasfield saw romance when he released a dozen heart-shaped balloons into the sky over Dania Beach with his sweetie. A Florida Highway Patrol trooper saw a felony.

Brasfield, 40, and his girlfriend, Shaquina Baxter, were in the parking lot of the Motel 6 on Dania Beach Boulevard when he released the shiny red and silver mylar balloons and watched them float away Sunday morning.

Also watching the romantic gesture: an FHP trooper, who instead noted probable cause for an environmental crime.

I bet that Highway Patrol trooper isn't very popular right now.

Okay, I get that the balloons could deflate and land in the park, which could harm the animals there. But at the same time, how the hell is it fair to turn a romantic gesture into a crime?

If he ends up with a conviction over this, it could ruin his life.

Releasing balloons shouldn't be a felony, however he should have looked into the law beforehand. Perhaps bought the power line friendly type.

Why should people be forced to check the law before they do something for their girlfriend? It isn't like he robbed a bank in order to buy her a new car, something that is, quite obviously, wrong. Laws used to be set up that, when people got caught, the defense of "I didn't know" didn't make sense. Now we are making felons out of people who release balloons.

That only makes sense if you believe the government is supposed to protect us from extremely unlikely events.

He deserves what he gets, for being stupid. "Dolphins, whales, turtles, and many other marine species, as well as terrestrial animals such as cows, dogs, sheep, tortoises, birds and other animals have all been hurt or killed by balloons. The animal is usually killed from the balloon blocking its digestive tract, leaving them unable to take in any more nutrients. It slowly starves death. The animals can also become entangled in the balloon and its ribbon making the animal unable to move or eat."

Yeah, the balloons are not Mylar, so what. That guy in Florida being charged with a felony is pure stupidity! That Cop could have given the guy a warning and done just as much good but oh no, a felony arrest looks good on the Cops employment record. Who cares if he ruins a guy's life when the Cop can be a look good motherfucker. There are way to many Cops that are disgusting human beings.

Nice sentiment, moronic move. The balloon guy should have known the laws before he decided to act. Moreover, at 40 years old a dinner and show may have gone a long way in the romance department.

Not only stupid, but cheap. Now he can spend his money on a lawyer the cheap bastard....he has his remedies at law and will be able to defend himself at trial.

Why should he know the laws? There are, quite literally, thousands of laws already on the books, and state legislatures and Congress pass more of them every day because idiots think that is their job. There is no way anyone can possibly know all the laws, so any argument that they should is based on the assumption that laws make sense.
