Rest assured that sometime when we have a democrat in the Oval Office, the same conflict of interest will arise as you are contesting there was with Holder and Obama.

Time to de-couple the Executive and the DOJ. Make it an independent agency just like we do with other agencies.

The conflict of interest is inherent in the system we have. If you're the AG, you have to investigate the guy who could fire you? If you're the head of the FBI, you have to investigate the guy who could fire you?

Irregardless of whether the President did or not...the fact that the President could is conflict enough.

What agency of the United States Government is not part of the Executive Branch?

Actually, there aren’t any ‘independent’ agencies – as all Federal entities are created by Congress and come under the purview of either the Executive branch of government or the Legislative.

Congress could – in theory – eliminate the Department of Justice and establish a new agency with law enforcement/investigatory powers.

The head of this new agency would be appointed by Congress and the new agency would be answerable only to Congress.

The legislation authorizing this new agency would have to be carefully written to ensure the head of the agency is as independent as possible and that the new agency be comprehensively non-partisan – a tall, perhaps impossible, order.

Needless to say, the hyper-partisan nature of Congress makes impossible the elimination of Justice and the creation of a new department responsible for enforcing Federal laws.

Again, the burden and responsibility belongs solely to the American people – along with the blame for the Trump debacle – the American people who put Trump in office, the consequence of their stupidity, laziness, and apathy.
