I wish it was actually possible to nominate a thread for a genuine award to be awarded by a Board vote. This thread would have to be a contender.

Not just the fact of the case law, itself. But the fact that it was the United States of America’s government and it’s Department of Justice which made the legal argument (then) on behalf of the former President (Bubba Clinton) to the court — and won.

Laughing....check again. The argument in Judicial Watch case was the difference between presidential records and personal records. With NARA arguing that Clinton's designation of tapes he'd made for a book that was to be written after the presidency were personal records.

You are claiming he's charged because he didn't give them back, while the others aren't being charged because they gave them back. All after they were supposed to give them back, all far longer than the duration Trump had them.

And he was President, which means all documents made during his presidency are his by law, unlike the others.

Nope. All presidential records belong to the United States.

And while in office the President IS the United States, at least he's the government as understood from an executive standpoint. And I'm sure they had copies of each document Trump had, so the question isn't about missing virgin documents, it's about copies.

Trump isn't president. He wasn't president when NARA demanded he return classified docs.

He wasn't president when NARA subpoena'd those same classified docs. He wasn't president when he turned over SOME of those classified docs. He wasn't president when he lied to investigators, compelled his lawyer to lie, conspired to hide the remaining docs in his possession, nor was he president when he showed classified docs to other people.

And all of those presidential records belonged to the United States.

And if had ANY classified docs, then there was no 'automatic' declassification order. As the classified docs that Trump admitted to having....wouldn't been classified.

And yet it was, by Trump's own admission.

There's a reason why Trump's attorney's have NEVER offered the 'telepathic declassification' argument before a judge. Its the kind of meaningless pseudo-legal horseshit that Trump feeds to people like you.

Even Judge Cannon is requiring everyone to get security clearance to view the docs. If the docs were already declassified.....why would you need security clearance to view them?
