Under the Executive Order signed by Obama concerning immigration, there are several requirements that have to be met................

1) Come out of the shadows, register and disclose all personal information.
2) SUCCESSFULLY pass a background check.
3) Pay all back taxes owed.
4) Pay any fines required.

After all that, a person is NOT granted citizenship, but rather they are given a work visa that allows them to remain in this country as long as they are gainfully employed and paying taxes and not committing crimes.

Those who are given a WORK VISA are only eligible to work. They are NOT eligible for the ACA, unemployment or any other benefits that are associated with being a citizen of this country.

Those who are given a WORK VISA are only eligible to work. They are NOT eligible for the ACA, unemployment or any other benefits that are associated with being a citizen of this country.

Companies will not get hit with the penalty because, as you point out, they are not eligible for ACA, and hence the employer will only get hit with the penalty if he hires American workers...who must be covered by some sort of insurance....

In order for it to be an "incentive" the employer would have to have information prior to hiring that is illegal for them to have prior to hiring.

It is against the law for the employer to ask the immigration status BEFORE hiring anyone, so in fact the business would have to break the law to have the "incentive."

It is not illegal for the legal illegal to announce his status. It makes a lot of sense for him to do so. It gives him an advantage in the hiring process. Background check already performed and 2k cheaper this year, increasing savings each subsequent year. I'd put it on my resume. Wouldn't you in this tough job market?
