The Los Angeles Superior Court issued an order Wednesday that restricts the pro-life group Center for Medical Progress from releasing any video that includes leaders of StemExpress taken at a restaurant in May.

Sure would like to know what is the basis of that decision. Is it a state that required the person being taped to have knowledge it was being done?
 
The 1st Amendment doesn't cover libel.

Since PP can prove that the original videos were intended to libel them they can legitimately block the release of any other materials from the same source.

The onus is now on the defendants to prove to the court that what they intend to release is not libelous.

That is going to be a hard bar to get over since they are already in the wrong over the first one.

When someone breaks the law the results of their crimes are subject to the law.

The organization that illegally recorded people broke the law and their video rightly shouldn't be allowed to be shown in the media.

How is using people's own words "libel"

And the onerous when it comes to prior restraint is ALWAYS on the government, and has to be a really good reason to pass constitutional muster. All that happened here is the Biotech company got lucky with a judge and got a temp restraining order before a real court decides the filming group did nothing wrong.

California's recording laws are pretty strict, but the recording was done in a public place, i.e. a restaurant, so confidentiality isn't an issue.

The Pro Life org did it's legal homework.
