Florida-based U.S. District Judge Aileen Cannon closed jury selection for the trial of an Alabama man — accused by federal prosecutors of running a website with images of child sex abuse — to the defendant’s family and the general public, a trial transcript obtained by Reuters showed. A defendant’s right to a public trial is enshrined in the U.S. Constitution’s Sixth Amendment.


Cannon, a 42-year-old former federal prosecutor appointed by Trump to the bench in 2020 late in his presidency, also neglected to swear in the prospective jury pool — an obligatory procedure in which people who may serve on the panel pledge to tell the truth during the selection process. This error forced Cannon to re-start jury selection before the trial ended abruptly with defendant William Spearman pleading guilty as part of an agreement with prosecutors.

In Cannon’s decision to close jury selection, the judge cited space restrictions in her small courtroom at the federal courthouse in Fort Pierce, Florida.

Legal experts said closing a courtroom to the public has been recognized by the U.S. Supreme Court as a “structural error” — a mistake so significant that it can invalidate a criminal trial because it strikes at the heart of the entire process. A public trial also has been found to implicate First Amendment rights of freedom of assembly, speech and press.

As a judge, Cannon so far has presided over four criminal trials that resulted in jury verdicts. She previously also worked on four criminal trials that resulted in jury verdicts when she served a federal prosecutor from 2013 to 2020, according to a questionnaire she filled out before the Senate confirmed her as a judge.

Because it's completely legal and normal to use evidence from out-of-district grand juries. The law specifically says it's okay.

And because the Trump team didn't raise the defense. Judge Cannon raised it. It's not a judge' s job to fake crazy law-defying rulings on behalf of one side, and doing so indicates blatant bias.

Judge Aileen Cannon in the Southern District for Florida federal court delivered a blow to Special Counsel Jack Smith’s inquisition against President Trump regarding the “classified documents” case. In their process, she also caused the liberals to go into unhinged meltdowns where they demanded her dismissal. Previous reports on her coverage can be found here and here.

As Politico’s Kyle Cheney reported, Cannon struck down two of Special Counsel Jack Smith’s sealed filings in her ruling today. Cheney said she came out swinging.
Judge Cannon comes out swinging at special counsel this morning, striking two of prosecutors’ sealed filings and demanding an explanation of “the legal propriety of using an out-of-district grand jury proceeding to continue to investigate” the docs case.

The Gateway Pundit’s Cristina Laila previously reported that this is not the first time Jack Smith has been smacked down by Cannon. She had previously denied motions to keep the government’s motion government’s motion to keep a list of 84 witnesses under wraps.

She also denied his request to speed up the sharing of classified documents.

Way to go Judge Cannon, this is a witch hunt and political interference.
The key is the DSA/Democrats want to run another `Star Chamber` operation where they can alter evidence and attest to it with no public oversight. Basic fairness allows a defendant to face his accusers and the right to impeach same witnesses.
Next thing you know, Smith will hire (never disbarred) DOJ Attorney Clinesmith to provide err "improved" evidence.
Or, Where can the DOJ find a corrupt Judge when they need one?
It only takes ONE legit judge to blow their cover.

But that's not what the Judge is asking. Try again. Well it's also not a defense...and additionally, yes the Judge is allowed to raise issues sua sponte....yes, Judges routinely raises issues sua sponte.

Latin for "of one's own accord; voluntarily." Used to indicate that a court has taken notice of an issue on its own motion without prompting or suggestion from either party.

As a general rule, where grounds for dismissal exist, an action is subject to dismissal on a court's own motion. A trial court has the power to dismiss an action sua sponte for want of prosecution, or failure to comply with the rules of civil procedure or a court's orders. A court may sua sponte enter a motion to dismiss for want of jurisdiction even though both parties have agreed to appear in the court.

But all federal judges sitting today were nominated by either a Democrat or a Republican. If every Republican appointee, or even every Trump appointee has to recuse themselves, that leaves Trump to be tried only by Democrats, or by a Republican who would have to be specifically chosen for being a Republican. Either way, it would seem highly political.

But, we have to expect that. The cases against Trump are purely political. No Democrat president or candidate would ever be prosecuted the way Trump is being prosecuted. When you politicize the justice system, it seems foolish to complain about the justice system being politicized.

Not claiming that Cannon is unbiased. Her telling Nauta (his lawyers, really) to tell her what they think of the prosecutor's propriety does sound like she's fishing for something to attack the prosecutor for.

Ok, so be it. An incredibly biased prosecution is being countered by a biased judge. Still won't be fair, because the whole thing lost all pretense of fairness long ago. But whining and crying because Trump has one judge in his favor is laughable.

Judges take a oath to uphold the law and not have an allegiance to uphold a party. Unlike the rank and file who have no allegiance to the law but do to a party. So they do not trust judges unless they are affiliated to said party. So if people hold judges up to the standard of upholding the law then they would complain but at least it would be fair.

No the charges are very real. We are seeing a real life political prosecution in this country, much like we’ve seen in other leftist regimes, like national socialist Germany. Saddam s Iraq, castro’s cuba, statin and putin’s russia, China etc
