Hamas has around 30,000 members, of which around 5000 constitute the so called al-Qassam Brigades, of which in turn some hundreds took part in the attack onto IDF positions and civilian targets on Oct. 7th. It will be more or less impossible to identify and punish those hundreds that took part in the raid.
That the Hamas leadership needs to face a court is understood - but the same would apply to the IDF, Netanyahu and his government leadership that is responsible for the indiscriminate murder of so far 10,000+ civilians.

Somebody fires 5000 rockets into Israeli neighborhood at dawn so that they will kill a maximum number of people--well over 1000 as it turned out--no reasonable person on the planet would see that as Israel's fault. Or that Israel isn't justified in using maximum force to eradicate the enemy so that they don't do it again which they have pledged to do.

The Fatah was officially renamed the PLO I think in 1968--I'm working from memory here--but Arafat was instrumental in the original organization of the Fatah, in the 1950's and he began his terrorist attacks on Israel in the 1950's. No Palestinians were removed from Israeli territory until the Arabs attacked Israel in 1948. Thousands more left Israel voluntarily in 1967 in advance of Egypt, Jordan and Syria intentions to attack and conquer Israel. When Israel defeated their enemy in the 6-day-war they did not allow the disloyal Palestinians to return.
The descendants of those Palestinians that chose to stand with Israel are now full Israeli citizens with representation on the Knesset.
