Here's the problem with background checks. To refuse to sell a gun to someone who has failed their background check is a violation of the second amendment.

no it isn't because the second amendment only restrains government action. If your boss fires you for making rude comments about his appearance that is not a violation of the first amendment if your boss is not a government agent. and if your boss fires you for wearing a t-shirt that says FUCK THE GOVERNMENT that is not a first amendment violation either
A Government entity requiring a gun shop to not sell guns to someone who fails the background check is a violation of the second amendment. If the gun shop does it on their own, ok. But if the government tells them to not do it it's not ok.
