I understand your thinking, and your take may be 100% correct, but the repair person wasn't hired to recover files, he was hired to fix the laptop. The way I understand it, the files were deleted ones that were restored. A repair person would never run a recovery tool unless he was hired specifically for that purpose. As I also understand it, it is a major newspaper outlet who actually ran the recovery of the files.
