This has nothing to do with collective bargaining as far as I know. This is about class action lawsuits. That is another case altogether and has its own problems (such as the workers getting almost nothing where the lawyers take the lions share of the suit).

To the OP: this is something that congress can pretty easily solve in the future if the dems are so inclined. While the ruling does not disallow the practice on constitutional grounds it is certainly possible to simply pass a law making such requirements non-binding. I don't really like what this ruling means but that does not mean that it was not sound.

They have not lost any 'rights.' This just means that companies can require arbitration rather than a class action suit - something that the employee was NEVER a party to in the first place. As a matter of fact, many times you LOSE rights in a class action suit. You completely lose the right to litigate on your own and are paid a pittance. Class actions suits are not for workers - they are for lawyers.

The only real saving grace a class action has is the fact that the dollar amounts are astronomical many times and that acts as a deterrent. It is not, by any means whatsoever, a reasonable or just process. Really, litigation for such issues needs to be restructured entirely.
