Things that a Homeowner's association can do :
*Refuse to allow the sale of a home under the jurisdiction of the HOA, to a convicted criminal.
*Require that the property under the jurisdiction of the HOA to be maintained, and not to be altered to the point where the property is a different product than the other homes under the HOA's jurisdiction and/or reduces the property's market value and the market value of other properties under the HOA's jurisdiction.
*Require that the homeowner have full coverage homeowner's insurance and flood insurance, and submit to inspection for quality assurance purposes and to submit to the services provided by repair personnel and exterminators supplied by the HOA.
*Require that the lawn and plants be taken care of and well maintained and be free of weeds.
*Refuse to allow the homeowner to have the property under the HOA's jurisdiction re-zoned.
*Require that the mortgage be paid, and that the Electricity, Water and Gas be paid for on time.
*Ban Homeowners under the HOA's jurisdiction from making repairs to the property without the HOA's knowledge and approval.
*Ban Homeowners under the HOA's jurisdiction from economic activity inside the property under the HOA's jurisdiction.
*Ban Homeowners under the HOA's jurisdiction from owning dangerous breed dogs / wild animals.
*Ban Homeowners under the HOA's jurisdiction from repairing / washing their automobiles on HOA property.
*Evict Homeowners under the HOA's jurisdiction who are arrested for felonies.
*Evict Homeowners under the HOA's jurisdiction for Fighting / Bullying / Misconduct towards other people and for disturbing the peace repeatedly.
*Ban Agricultural crops / activity because of insect and pest activity drawn to it.
*Ban out-of-region plants, because of high risk of plant death... i.e. a Palm Tree in New York.
Things that a Homeowner's association cannot do :
*Discriminate on the basis of Race, Creed, Religion, Sex, Sexual Orientation, Sexual Identity, Age, Disability, National Origin, Veteran status, political beliefs and employment type.
*Require that Chattel be common with the chattel of other homeowners under the HOA's jurisdiction.
*Tell people what to cook for dinner
(but the HOA can issue you a fine, if you cook things that smell so bad, so powerfully that the stench penetrates the walls and disturbs other people in other homes under the HOA's jurisdiction)
*Stop a Homeowner from flying a sports team flag.
