Former AG Meese: Obama's 'Recess' Appointments 'Constitutional Abuse Of High Order'

Ron Paul: “By making ‘recess’ appointments to the Consumer Financial Protection Board (CFPB) and the National Labor Relations Board (NLRB) when Congress is not actually in recess, President Obama has acted in clear disregard of the Constitution…And the President must be called to account for his actions.”

If you don't think that congress is actually in recess, maybe you can explain why 99% of the US Senators and House members are not in Washington DC.
And someone shows up every couple of days, gavels in for one minute, and leaves.
I hope they do fight Obama on this.

What a sham. And everyone KNOWS it's a sham.

Just out of curiosity, has anyone researched whether or not a quorum is required in order to be considered truly 'in session' since I believe a quorum is actually required in order to vote on Senate and House business?
 
When it comes to credibility the Meese name is one of those at the bottom for the following reasons:

1. The Reagan/Bush Savings and Loan Heist aka home loan scandal sent the economy out the window costing taxpayers many many $$ trillions (Cost taxpayers $1.4 trillion), Plus millions of jobs, loss of retirement plans and loss of medical insurance.

2. Iran Contra Illegal Weapons Sale - Reagan/Bush and Iran were good buddies on this deal

3. Blind eyes watched questionable mergers,hostile takeovers and leveraged buyouts
 
In a Washington Post editorial Thursday, Edwin Meese, the former U.S. Attorney General under President Ronald Reagan, and Todd Gaziano, Director of the Heritage Foundation’s Center for Legal and Judicial Studies, wrote that President Obama’s unilateral appointment of three individuals to the National Labor Relations Board, and of Richard Cordray to head the new Consumer Financial Protection Bureau, while the Senate was not in recess, is a “breathtaking violation of the separation of powers and the duty of comity that the executive owes to Congress.”

As if we were not already aware, “Congress” includes Minority Leader Nancy Pelosi, who, naturally, praised the president for trampling over her branch of government. Regarding Mr. Obama’s power grab, Mrs. Pelosi said, “…we’re glad that the president took the lead, went out there, it was bold and made the appointments.” (Translation: How else can I get the things I want since I’m no longer Speaker?)

But, “Congress” also includes Speaker John Boehner, whose response to the bird he was just flipped was that the president’s action is “bad for jobs.” Mr. Boehner said, “This action goes beyond the President’s authority, and I expect the courts will find the appointment to be illegitimate.” 

So that’s it? Just file a lawsuit and get back to the business of the day? No defense of the Constitution, of the separation of powers? No conditions placed on future legislation? No talk of impeachment?

During the past few congressional vacations, House Republicans have insisted on coming in for pro forma sessions every three days, triggering a clause in the Constitution that forces the Senate also to come into session.

Presidential spokesman Jay Carney said the White House doesn't consider pro forma sessions to be actual work by Congress. Even though the Senate has been convening in those sessions every three days, he said, "the president's counsel has determined that the Senate has been in recess for weeks and will be in recess for weeks."

Republicans are pissy because their trick backfired and blew up in their faces. Too bad. Take it to court.

I don't think the President gets to decide when Congress IS or IS NOT in session.


I think that the American public will decide, on their own, whether McConnell's gimmick is legit or not.

The Daily Show showed a clip of just how long the Senate is convening for - something like 20 seconds.

Next time it's a Democratic Senator, another Democratic Senator should show up and pass a bill, with 2 votes. :lol:

A couple of points:

The Republicans are being too cute by half. I think that, regardless of any court decision on the constitutionality of what Obama did, the Republicans are going to lose the PR war JUST LIKE they did last year when the House tried to play a game with the extension on the payroll tax rollback.

Secondly, I think Republicans may be misinterpreting Obama's low poll numbers as being something other than what they really mean.

When any president gets 'rolled' by a congress of the opposing party, of course his poll numbers are going to be low because he's seen as ineffective. But the current Congress poll numbers are about a 1/4 of what Obama's numbers are. So, when Obama stands up to the Republican Congress and refuses to let them act in an obstructionist way, I predict his poll numbers will actually go UP!

When something Violates the Constitution in your view, bring it to Court or stfu.
