It was the same war. There was no armistice; only a ceasefire that was violated by Iraq.
You obviously no longer have a ceasefire when both sides are firing but the most important term that was violated was the right to inspect possible WMD preparation sites. The UN did in fact give Saddam an ultimatum that he defied. Clinton bombed the crap out of Iraq, you don't think that was an act of war?
