Dictator Trump's Appointment of AG Whitaker Is NOT Constitutional

Jeez such a to do over nothing.
Dems take the House in Jan.
President Trump will give his choice of the permanent AG in Jan. and then they vote on the new nomination.

Whitaker isn't going to do anything.
There is no reason he would interfere with the investigation.
All he said was it should not become a fishing expedition and should be focused on what the investigation is about, which is collusion.

If the Dems want a financial investigation they need to do so through the House Committee at the beginning of the year.

Rosenstein was nominated by Trump and confirmed by the Senate as Deputy Attorney General. Therefore, Rosenstein should be the acting Attorney General - not Whitaker.

He doesn't have to put the next in line in. All the person has to do is be in the Administration at a level 15 for the minimum of 90 days prior to his temporary appointment, and can NOT hold the office longer than 210 days. THAT IS THE LAW, like it or not!

Doesn't have to be ROSENSTEIN according to the constitution. Just has to be someone at level 15 for 90 days PRIOR to the temporary appointment, which Whitaker was, and is!

He was not vetted and appointed under the advice and consent of the Senate.

Because it is an interim position, and because Trump has the authority to make unilateral lower-level employment decisions in the DOJ, Trump can fire every motherfucker that stands before Whitaker.

This is shaping up to be an interesting court battle, that the SCOTUS will likely hear and could end up shoot down the law as unconstitutional. It seems to me that the intent of the successor statute is for "Designated Survivor" scenarios, but I expect the SCOTUS or any lower court to look at the language of the statue and give it the proper meaning as written before moving to constitutionality grounds.

Dopey brother? IRRELEVANT-------->this thread is about UNCONSTITUTIONAL appointment, which it is not! He can not serve more than 210 days, that is the law. It is up to the President to decide who he wants TEMPORARILY in that position, while he chooses another candidate for confirmation. NO WHERE in the constitution, does it say the President MUST pick the deputy AG as the replacement.

If it does, show us where it is!
