Dershowitz: ‘You Cannot Charge a President With Obstruction for Exercising His Constitutional Power’

So the president is above the law ?

YES

On June 20, 2012, President Barack Obama asserted executive privilege, his first, to withhold certain Department of Justice documents related to the ongoing Operation Fast and Furious controversy ahead of a United States House Committee on Oversight and Government Reform vote to hold Attorney General Eric Holder in Contempt of Congress for refusing to produce the documents.

Later the same day, the United States House Committee on Oversight and Government Reform voted 23–17 along party lines to hold Attorney General Holder in contempt of Congress over not releasing documents regarding Fast and Furious.

Executive privilege was also used in a lawsuit stemming from the 2012 implementation of the "Net Worth Sweep" against Fannie Mae and Freddie Mac. The Obama administration did not disclose roughly 11,000 documents from the plaintiffs in the discovery process as they related to the reasoning behind the 2012 actions.

Executive privilege is somthing else.

You are saying that a prez can’t be found to be a criminal for somthing he did even before he was president ?
no. many of us are simply saying you're a self-serving idiot who in your child like ways must get what you want or you'll scream.

again.

"While a president does have the power to fire an FBI director, he does not have the authority to do so if it would violate the law. Past presidents have been held accountable for obstruction of justice. The Articles of Impeachment against both Presidents Nixon and Clinton cited their alleged obstruction of justice as justification for why they should be removed from office. Our Constitution gives the president the responsibility to “take Care that the Laws be faithfully executed.” It does not give the president the authority to act in violation of the laws, including the laws on obstructing federal investigations." - Kathleen Clark, expert on legal ethics and professor at Washington University in St. Louis - Can the President Obstruct Justice?

There's no possible way that firing the FBI director would violate the law.

So the president is above the law ?

What part of "for Exercising His Constitutional Power" didn't you understand?

Obstruction of Justice is a constitutional power?

No, you fucking moron, firing Comey is a Constitutional power of the president.

Not if it's done for the purpose of obstructing justice.

ROFL! Derschwitz just explained to you that he can't be charged with obstruction of justice for exercising his Constitutional powers.

You're retort amounts to saying "nuh uhn!"

You're a fucking moron.

This is for all the forum idiots who think Mueller can charge Trump with obstruction of justice:

Monday on Fox News Channel’s “Fox & Friends,” Harvard law professor Alan Dershowitz batted down the merit of obstruction of justice charges aimed at President Donald Trump for what he said was exercising his constitutional power and authority regarding the firing of then-FBI Director James Comey and instructing the Department of Justice what to and not to investigate.

“If Congress were to ever charge him with obstruction of justice for exercising his constitutional authority under Article 2, we’d have a constitutional crisis,” he explained. “You cannot charge a president with obstruction of justice for exercising his constitutional power to fire Comey and his constitutional authority to tell the Justice Department who to investigate, who not to investigate. That’s what Thomas Jefferson did. That’s what Lincoln did. That’s what Roosevelt did. We have precedents that clearly establish that.”

He can charge Trump with obstruction of justice. Dershowitz is wrong.

Dershowitz is one lawyer's opinion, don't forget. Nothing more or less.

The difference is that Derschewitz has logic on his side. You have pure idiocy on your side.

No he can't, moron.

Mueller can't- you can't charge a sitting President with anything.

But the House could charge the President with Obstruction.

Would the GOP EVER charge Trump with anything- even if there were photo's of him handing over the nuclear codes to Putin in exchange for a suitcase full of diamonds?

Don't think so.

You need to think again, I bet they would prefer Pence as the president over the orange clown nine-to-one.

If pigs had wings they could fly. Not going to happen, moron.

I agree. There's no possible way that firing the FBI director would violate the law.
`
`

I agree. At issue here is "intent." I, at least, do not question his legal authority to terminate his own staff. However, was it done for the intent of interfering with or suborning justice, is the questioning being proposed.

btw Jeff Sessions, the AG, voted to impeach Bill Clinton for obstruction of justice.

Those who argue that the President inherently cannot be charged with obstruction of justice are inherently the enemies of We the People and must be dealt with as such.

Their argument makes Trump a neo-dictator, a first step to a totalitarian government.

Clinton wasn't excercising his Constitutional powers when he coached Lewinski and his secretary how they should testify, and when he tried to bribe lewinski with a high paying job for keeping her mouth shut.

The Constitution says the president has the authority to fire anyone in his employ for any reason, period. The Constitution is the law.

Cite the law. Just being mad at him isn't enough.

Trump has to cite the law, and he cannot do that.

He wants to argue that by virtue of his office he is immune to obstruction of justice. That argument is philosophical, interesting, and inherently worthless to how our government and law operate.

Well there is this.
Trump’s lawyer: the president can’t obstruct justice. 13 legal experts: yes, he can.

President Trump’s lawyer, John Dowd, apparently believes the president cannot be guilty of obstruction of justice because he’s the president.
The “president cannot obstruct justice because he is the chief law enforcement officer [under the Constitution’s Article II] and has every right to express his view of any case,” Dowd told Axios’s Mike Allen.
But is that true? To find out, I reached out to 13 legal experts and asked them a single question: Can the president commit obstruction of justice?

yea, cause that's what he was hired to do.

again - you don't give a flying shit what you find, but find something.

shit mentality needs to go all around.

It was EXACTLY what he was hired to do. Financial records is how you follow the Russian money.

And let me remind you that we've had another Special Prosecutor and he WAS CERTAINLY NOT hired to look for Clinton's blowjobs. So that ship has LONG SAILED.

Didn't Nixon do that ?? See how far that got him?

No, it wasn't what he was hired to do. Investigating Russian interference in the election is what he was hired to do. Trump's activities with Duetch Bank have nothing to do with that since they all occured long before he announced. Nothing Mueller has done has anything to do with "Russian collusion."

He's a scumbag. Time to terminate him.

You mean 13 douchebag leftwing propagandists say he can. A leftist will say anything if it promotes their agenda.
