So here you have a situation where Congress passed a law that empowered the EPA to regulate certain kinds of pollutants. We all know what "pollutants" are: they are harmful chemical substances that are produced by commercial enterprises, different from the chemicals that they started with (or at raised and lethal levels). Knowing that it would not be possible to identify each and every such pollutant, they told the EPA to make the definitive list.
The EPA then takes it upon itself to label CO2 as a "pollutant." This is (A) Bullshit; CO2 is a normal and natural product of nature, indeed we humans produce it constantly as long as we live, and (B) an order of magnitude beyond what Congress authorized that Agency to do.
Why? Because (i) Congress has not, by law, declared that "global warming" is an imminent, real threat, and there is considerable disagreement on whether it is, and (ii) in declaring CO2 a "pollutant," the EPA has taken upon itself the power to regulate ALL commercial and even agricultural activity, at a Federal level...which goes way beyond what the Constitution permits.
So the "solution" for the "global warming"/"climate change" crowd is to either pass a law that says that CO2 is "pollution," or pass a law that says it is the goal of Congress to save the world from climate change. But lacking the votes to get either of theses laws or changes passed, it has RELIED ON THE COURTS TO CHANGE THE LAW, or TO DO WHAT THE LEFTISTS IN CONGRESS WANT TO DO, BUT LACK THE VOTES!
Sound familiar? It is the SAME as wanting, but lacking the votes, to codify Roe v Wade into law.
