(Reuters) -A federal judge in West Virginia has ruled that a federal ban on possessing a gun with its serial number removed is unconstitutional, the first such ruling since the U.S. Supreme Court dramatically expanded gun rights in June.

U.S. District Judge Joseph Goodwin in Charleston on Wednesday found that the law was not consistent with the United States' "historical tradition of firearm regulation," the new standard laid out by the Supreme Court in its landmark ruling.

The decision came in a criminal case charging a man, Randy Price, with illegally possessing a gun with the serial number removed that was found in his car. The judge dismissed that charge, though Price is still charged with illegally possessing the gun after being convicted of previous felonies.

Price's lawyer, Lex Coleman, called the decision "thoughtful, measured and accurate." A spokesperson for the office of U.S. Attorney William Thompson in Charleston, which is prosecuting the case, said the office was "reviewing the ruling and assessing options."

The federal law in question prohibits anyone from transporting a gun with the serial number removed across state lines, or from possessing such a gun if it has ever been transported across state lines.

Serial numbers, first required by the federal Gun Control Act of 1968, are intended to prevent illegal gun sales and make it easier to solve crimes by allowing individual guns to be traced.

Price argued that the law is unconstitutional in light of the Supreme Court's June 24 ruling in New York State Rifle & Pistol Association Inc v. Bruen. That ruling held that under the Second Amendment of the U.S. Constitution, the government cannot restrict the right to possess firearms unless the restriction is consistent with historical tradition.

Bruen said serial numbers were not required when the Second Amendment was adopted in 1791, and were not widely used until 1968, putting them outside that tradition.

Your ignorance is astounding. If a person can't own a gun without a serial number, why is it still federally-legal for a law-abiding person to manufacture a firearm, and not requiring them to have it marked with a serial number?

Welcome to the results of your side pushing for de facto bans over and over. You are getting pushback now. You could have had basic regulations, but you wanted things like months long waiting periods and bans on certain common weapons, so this is what you get for your obstinance.

Same as with the abortion rights people, they pushed and pushed and pushed for zero restrictions, and they got Roe overturned because of it.

Serial numbers very rarely matter in solving gun crimes, since they can be easily bought at gun shows, flea markets, or even garage sales. All they can do is point back to the last known owner who purchased the firearm and filled out the ATF Form 4473.

You have no idea how many guns are out there, waiting to be legally purchased without any paperwork. And yes, it is legal for an individual to sell their personal firearms, as long as they don't knowingly sell to a minor or a felon.

Criminals don't "insist" on unmarked guns, that's idiocy. Criminals use whatever guns they can get, and the chances of law enforcement actually tracing a serial number back to the criminal is next to nothing. That's because they rarely ever legally purchase their firearms from a dealer, or fill out any paperwork.

That's also because people who do purchase firearms through channels, rarely ever commit crimes. That is, unless your name is Hunter Biden. In which case, you'd purchase a pistol while being a drug addict, and then wouldn't even get convicted of the crime you committed. So if you have a problem, I would suggest writing a strongly-worded letter to Hunter Biden's father. Here's the address:
