At my age, I have had hundreds of jobs, and OSHA is ONLY advisory.
Any worker at any time can deliberately violate OSHA recommendations.
The ONLY person who can NOT violate OSHA is the employer.
For example, the employer has to provide safety harnesses for elevated work, but no worker has to ever actually wear the harness if they do not want.
You need to read up more before making statements you do not understand.
Normally the federal government would have zero jurisdiction over workplace safety at all, since it is not authorized jurisdiction in the Constitution.
The only reason there is any jurisdiction to the federal government is through the 14th amendment, which allows the federal government to protect individual rights. But the authority to protect individual rights does not mean the government then can mandate something AGAINST the desires of the individuals. That would be violating individual rights, not protecting them.
