The intruders blocked people from freely moving in and out of the church, but all Lemmon did was stop people in order to ask them questions. They were free to ignore him, and he did not try to prevent them from leaving.

Actually the judge has to give the DOJ great deference to their descriptions.
We saw it many times, where later evidence caused them to take back their descriptions and had the judge drop the charges.

They will file a motion for a hearing, where both sides submit their evidence. That's when a judge can make a decision to dismiss charges

Doesn't matter. They should not have gone into the church and he should have known that sort of thing is frowned on, if not against the law. In my eyes he made himself complicit by going in with them.
