There is no power on the federal level to create those holidays but that can be done on the state level unless their constitution says otherwise. That is probably where those official holidays showed up in history.

There is nothing unconstitutional about the government deeming a national day of prayer.

The goal of his administration, and the radicals he surrounds himself with, is to "fundamentally transform" the country. Here is my solution to this that should make everyone happy. If you want a day of prayer do it on the state level this way it won't violate the first amendment since it is specifically a limitation on the federal congress as in "congress shall pass no laws...". This way those that like this can have it in their own states and those that hate christians can do away with it and have their own 'burn'em at that stake' holiday.

Actually, once the ruling goes into effect (all appeals exhausted) then it is illegal. Until then, it is legal (as how as much I disagree with it) and will be this year.

Using the writings of Thomas Jefferson I would tell them the Constitution wasn't strictly left up to you jerks to interpret. That is true. Everyone assumes that the other branches of the government have to obey the judicial branch but the judicial branch's power is in its power of arbitrator between two sides such as the defendent and the government. When someone is accused of an unconstitutional law then that court decides that the law is unconstituional and thus making the law unenforceable since the government has to use the court system to prosecute someone. The court's power only extends to cases brought before it and not to directing what the other two branches of government can do.
