Jan 7 2026 A white mother and son will pay more than $90,000 to a Black former Carroll County neighbor after a judge determined they violated the Illinois Hate Crime Act through months of harassment and intimidation.

The state attorney general filed civil action in 2022 against Chad Hampton, 49, of Victoria and his mother, Cheryl Hampton, 70, of Streator, saying they displayed a racial slur in front of a Confederate flag facing their neighbor's house. In addition to displaying swastikas, the two "used a noose to lynch a bound and chained effigy of a Black man made to resemble" the neighbor where he could see it, according to Attorney General Kwame Raoul.

It was the first civil hate crime lawsuit filed by Attorney General Kwame Raoul. The Legislature amended the Illinois Hate Crimes Act in 2018 to give the attorney general the authority to file civil lawsuits against those accused of hate crimes.

"This behavior is shocking, racist and un-American. I appreciate the judge’s order that shows such despicable behavior will not be tolerated in our state," Raoul said. "With dramatic increases in reported hate crimes, I will continue to use all of the tools at my disposal to prosecute hate crimes and send the message that hate has no place in Illinois."

Sounds fine to me, generally. The thing with the swastika and hanging an effigy of their black neighbor pretty much crossed a line, with the state and with basic human decency.

On the other hand, I would feel better about it, if there had been a jury, instead of a bench trial. With the Attorney general filing the civil complaint, and it being decided in a state court, by a state judge, it smacks, a little of control of speech (admittedly horrible speech) by the state.
