He has always been able to pardon his staff. There is no judicial review of pardons under the constitution. It is one of the few raw powers of the presidency in the same way that impeachment is a raw power of the Congress.

Other than that, this is about leaders having some latitude to make difficult, borderline criminal decisions. American intelligence agencies require similar protections this is why there is a pardon process etc. We couldn't imagine the types of tough decisions a president must make be it ordering the murder of Bin Laden, the use of drones to target terrorists etc.

It's a vicious world out there especially for Americans who their enemies (and some allies sadly) love to paint as the devil. A president has to ensure that these people are confronted.
