Psst - El Salvador is his home country, the country the Judge ordered in 2019 (Trump Administration) that he NOT be sent to.

There was no evidence presented in the court record that he was a gang leader. You know, not claims, actual evidence.

Stayed by SCOTUS, now remanded back to District Court for clarification.

Due to the administrative stay issued by The Chief Justice, the deadline imposed by the District Court has now passed. To that extent, the Government's emergency application is effectively granted in part and the deadline in the challenged order is no longer effective.

The rest of the District Court's order remains in effect but requires clarification on remand. The order properly requires the Government to "facilitate" Abrego Garcia's release from custody in El Salvador and to ensure that his case is handled as it would have been had he not been improperly sent to El Salvador.

The intended scope of the term "effectuate" in the District Court's order is, however, unclear, and may exceed the District Court's authority.

Essentially, they said the US must aid in the return of a man whom was deported "by mistake" back to the US. Yes, Trump made a mistake here. Yes, the Supreme Court nailed it.

The US has produced no evidence of such.
They haven't had to until now... so stay tuned he will not be released into the country he will be hauled into a deportation court... if he is not a gang member he is still an illegal alien who has been ordered to leave the country 6 years ago...
But I don't think he is an innocent migrant... he is MS13 that is what his own lawyer said... he said he is in danger from rival gangs...
 
He will just be deported again if he is brought back.

The same people who had no problem with J6ers languishing in prison for years without a trial.


All they have to do (which is what his trial court lawyers sought) is to send him to the U.S. Embassy in El Salvador, which is U.S.territory. From there he can be deported elsewhere.

The Justice Department in a Supreme Court filing on April 7 stated that while Abrego Garcia was deported to El Salvador through "administrative error," his actual removal from the United States "was not error." The error, department lawyers wrote, was in removing him specifically to El Salvador despite the deportation protection order.
The dude will be deported it just will take longer and cost the taxpayers more... but he is gone... if he can't go to Venezuela he will go to another country...
We do not have to keep him here just because he is in the wrong gang... that would be stupid....

I'm fine with after the government corrects its mistake and provides Due Process that Abrego Garcia be deported properly to a 3rd party country that will accept him.

Something the Trump Administation could have done in 2019.

This is just the beginning.

Our tax money is going to make a lot of these guys wealthy because of trump. All that money they were supposed to be getting from welfare is a pittance compared to the millions some of these guys are about to get from our government. It would have been better to let them stay here illegally and get whatever benefits the right claims they get, than the payments the courts will make the government pay. This is the price of racism.

US Supreme Court upholds order to facilitate return of deportee sent to El Salvador in error

The U.S. Supreme Court upheld on Thursday a judge's order requiring President Donald Trump's administration to facilitate the return to the United States of a Salvadoran man who the government has acknowledged was deported in error to El Salvador.

U.S. District Judge Paula Xinis on April 4 issued an order that the administration "facilitate and effectuate" the return of Kilmar Abrego Garcia, in response to a lawsuit filed by the man and his family challenging the legality of his deportation.
