The consultation seeks to address these gaps by creating a fairer system for the millions of couples who choose not to marry.

Particular attention is being given to women, who are statistically more likely to experience financial disadvantage following separation, especially where economic dependence or childcare responsibilities have developed during the relationship.

The proposals suggest that a couple would qualify if they:

Have lived together for at least three years; or
Have a child together, regardless of how long they have lived together.

It's not really what most people think it is. Timeline has nothing to do with it.

Every state that recognizes common law marriage requires:

1. Legal capacity – both parties are of legal age and not already married.
2. 
   
3. Present mutual agreement – both must agree to be married now, not just to marry in the future.
4. 
   
5. Cohabitation – living together as a married couple.
6. 
   
7. Public presentation – openly holding yourselves out as husband and wife to the world Recording Law+1.
