I contend the executive branch is actually usurping the authority of the judiciary to be the judge of whether Garcia and his fellow deportees deserved to be sent to El Salvador. The regime is trying to bypass one of the three branches of government and consolidate power for itself. It believes it has the power to send those people to a foreign gulag, most likely for the rest of their lives, without judicial review. This is trump's domestic policy solution for removing alleged gang members. Not foreign policy towards El Salvador.
Remember, even the enemy combatants sent to Guantanamo were given the opportunity to have a judicial process weigh in on their fate.
