The argument that the 14th doesn't apply to him because his oath to the constitution is even greater than a Senator's etc???? Not only does he have to defend it, but the duty of preserving it....both through the DOJ and legal system of the Executive branch..... He does have to support it....to say he doesn't, is silly.

This idea that everyone who participated in an insurrection or aided and abetted the enemy from within, does not include the president or vice president aiding the enemy is ridiculous.

That would mean most democrats are ineligible to run for office. Anti second amendment depriving people of their rights is not up holding their oath

Nope. Nothing to do with the oath. The President (and the VP) are simply not listed as subject to this provision.

Not at all. There are other remedies for the President, namely impeachment. In case you forgot, your team charged huim with insurrection. There was a trial. He was acquitted.

What arguments are you going to make to these Judges to overcome that?

Biden's own DOJ has charged over a 1,000 January 6th participants. Not a single one charged with insurrection. Pretty steep hill to climb arguing that Biden's DOJ are clueless misfits that don't understand Federal law.
The sedition charges covered the insurrection and MORE, with heavier penalties...so they chose seditious conspiracy as the charge to cover both...

Oh, and on the Insurrection impeachment, the clear majority of senators found him guilty, 57 to 43.....not enough to remove him, but he was already gone so....Rs like McConnell and others, said he was guilty but did not go on to convict him, because he was already out of office, when the impeachment took place. More Senators from his own party, voted to impeach him, than any other president, impeached....for insurrection.

“Former President Trump’s actions that preceded the riot were a disgraceful, disgraceful dereliction of duty,” added McConnell. “Trump is practically and morally responsible for provoking the events of the day.”
