As for the law it is clear if ONE of the NATURAL parents is an American citizen the Baby gets a passport. It does not matter if the other parent was not a citizen and the only thing the Consulate can do is ask for prove the offspring was from the American. If the Natural parent is the Father that requires a paternity question if the Mother then no test is required.

Marriage is not a matter of consideration BUT to that it is LEGAL through out the US for Gays to marry so a gay married couple can not be denied the same benefits by the Federal Government as a Heterosexual Couple..
