I agree 100%. IMO Trump would have to be either convicted in a courtroom or in a senate trial after impeachment for eligibility rules to apply. Neither has happened, so he is a valid candidate.

President Trump’s team was constricted immensely by a ridiculously narrow window of just a few weeks to compile data from an obfuscated election system that was bolstered by unprecedented COVID-19 mail-in balloting rules put in place. It was reminiscent of the Wild, Wild West. And still, cases were brought, and quickly dismissed, typically using procedural justifications such as “standing” or “laches” before any evidentiary hearings or discovery was permitted.
The Gateway Pundit has documented numerous examples of unresolved issues and concerns from USPS employees appearing to stuff piles of ballots into drop boxes in Michigan, to two 4am deliveries in the backdoor of the TCF Center in Detroit, more than 20,000 ballots delivered after the deadline in Maricopa County, the mysterious disappearance of Jesse Morgan’s USPS trailer that he claims contained around 250,000 filled out mail-in ballots transported from NJ to PA, and “erroneous code” being found on almost every Georgia county who’s system log files were analyzed. In fact, just yesterday The Gateway Pundit published a report from Erich Speckin, a 20-year veteran contractor with the State of Michigan who investigated the 2020 Election AVCB ballots in Detroit and found there could be upwards of 35,000 illegal ballots.

But Trump as the defendant has a right to a defense. If it did not work before then at least his lawyers will be paid. This guy they use will be paid.

the numerous methods used by Democrat-controlled Wayne County to deny them
a meaningful opportunity to carry out the election duties described above. Some
of these methods include the following:
- Most of the challengers designated by the Republican Party or Republican
candidate were denied access to the TCF Center (formerly Cobo Hall)
while all Democratic challengers were allowed access.
- Those few Republicans who were admitted were not allowed sufficiently
near the vote counting process to have meaningful observation of it.
- Those few Republicans who were admitted were forced to remain at least
six feet from the vote counting process but Democrat challengers were not
forced to remain behind such a barrier
- At least three challengers swore Wayne County election officials physically
pushed them away from the counting tables so they could not meaningfully
observe the vote count.
- Many challengers swore they were threatened and harassed by Wayne
County election officials, including being called “a racist name.”
- One challenger observed Democrat challengers sharing a packet of
information entitled “Tactics to Distract GOP Challengers.”
- An election official told a challenger that Wayne County had a police
SWAT team outside the building if Republican challengers argued too
much.
- Another election official told a challenger that “since English was not [her]
first language…[she] should not be taking part in this process.”
- Whenever a Republican challenger was ejected from the counting area,
Wayne County election officials would cheer
Wayne County election officials ran batches of ballots through the vote tabulation
machines-some multiple times.

I'm going through litigation with a guy who has taken me to court 4 times and lost every single time because, like Trump, neither the facts nor the law are on his side. He's provide no evidence of any of his claims, while I've arrived at court with evidence of everything I've said.
There are numerous legal problems with this idea. The first problem is that whether the election was "stolen" is irrelevant to the crimes Trump and company committed. Even if they could prove every one of their claims of election fraud, what Trump did was still fraudulent, and illegal.
So there is simply no point in presenting evidence that Trump won the election, because it's not a legal defense to his crimes.
The prosecution will simply present evidence of the crimes Trump committed, and Trump will try to claim he committed crimes because the election was stolen.
(a) The prosecution doesn't have to prove that the election wasn't stolen, only that Trump used illegal methods to stop the certification;
(b) No competent attorney would even attempt to present such a defense since the veracity of the election is not at issue to the charges.

Well his lawyers have to present a defense. The defense mention sounds like the lawyer is trying to appease Trump and give him what he really wants. Trump will never get over the previous election and it will bother him for the rest of his life. That makes me happy.
He is in trouble and I can't see him winning a single case.
