The district court upended immigration-enforcement efforts throughout the entire Central District of California—a vast area encompassing some 20 million people and an estimated 2 million illegal aliens—by categorically enjoining immigration officers from conducting investigative stops that rest solely on any combination of four factors (i.e., a suspect's apparent race or ethnicity; whether he speaks Spanish or accented English; whether he is at a location where illegal aliens are known to gather; and whether his job is prevalent among illegal aliens because of the lack of documentation required.

They are arguing against that so how is it not arguing for detaining someone based on their "apparent" or "perceived" race?

You are absolutely delusional. The whole purpose behind the brief is to give ICE free rein, to confront, and perhaps detain people, on any one of four criteria. The first, the appearance of being, not Mexican, but Hispanic. You certainly didn't read the brief. Sure, they try to whitewash the whole thing, but it just keeps jumping out.

I mean on any given day I hear half a dozen languages being spoken. Sure, the most common is Spanish, followed by Hmong, Russian, German, and Mandarin. Can all these people be detained based on the language they are speaking or is it just brown people? Again, from the brief.

Needless to say, no one thinks that speaking Spanish or working in construction always creates reasonable suspicion. Nor does anyone suggest those are the only factors federal agents ever consider. But in many situations, such factors—alone or in combination—can heighten the likelihood that someone is unlawfully present in the United States, above and beyond the 1-in-10 baseline odds in the District. U.S.Immigration and Customs Enforcement (ICE) agents are entitled to rely on these factors when ramping up enforcement of immigration laws in the District.

Can you not see it? "Alone", that means appearance, "alone", justifies the detainment. That can't possibly fly. And notice the bar the government is trying to establish here, "beyond the I in 10 baseline. Even at three in 10, maids, housekeepers, it still doesn't meet the "probable" threshold. You have to exceed fifty percent, none of those criteria fit that, except, what I have conceded, hanging out at the Home Depot parking lot. And that is highly doubtful.

I mean all this deportation thing. It is for show, period. No way, by the end of the year, Trump even gets close to deporting the number of criminals that Biden did in 2024. I mean ICE is going after the low-hanging fruit. They are harvesting from the first three rows, something specifically admonished in the Holy Bible and the laws of Hammurabi. It is disgusting, it is sick, and it is lame.

John Sauer, the Justice Department’s solicitor general, said Thursday in a filing with the Supreme Court. “This Court should end this attempted judicial usurpation of immigration-enforcement functions” and suspend the injunction while the case is argued in the lower courts, Sauer wrote.

The Central District, which includes Los Angeles County and six other counties, has nearly 20 million residents, more than any other federal court district in the nation. It became the focus of legal disputes over immigration enforcement after President Donald Trump took control of the California National Guard in June and sent thousands of its troops to the streets in Los Angeles to defend immigration agents against protesters of workplace raids.

Here's a hint: let's take Los Angeles for example, and partition it up by income. You don't expect to see illegals living in Beverly Hills, or Bel Air, or the Palisades. So those areas have fewer than 10%. But if you move east, there's lots of illegals in Commerce, Bell, Paramount... those areas have more than 10%. Some areas have 30%. ICE would have a 1 in 3 chance just stopping a random person.

You can blame Biden for this mess. And the people who funded all those migrant caravans. It's their fault. Where were you when that was happening? Trying to convince us the migrants were "seeking asylum"?
