And this is the very reason why he opted not to do shows in the U.S.

1️⃣ Freedom of Association & Assembly​

  • The First Amendment protects people’s right to assemble, attend concerts, protest, worship, etc.
  • Courts recognize a “chilling effect” if government action makes people reasonably fear exercising that right (NAACP v. Alabama is a classic example).
  • But there’s no absolute bar: the government can still enforce neutral laws (like criminal statutes or immigration laws) even at public gatherings.

2️⃣ “But if they’re here unlawfully…”

  • Immigration law is civil, not criminal. ICE does have authority to apprehend people it believes are unlawfully present.
  • However, targeting specific events known to draw particular groups can cross into selective enforcement or retaliation if done with discriminatory intent or for political optics rather than legitimate enforcement.

Bad Bunny’s not skipping the U.S. because he’s worried about himself — he’s a U.S. citizen, and ICE can operate in Puerto Rico too. He’s worried about his fans. On the mainland, ICE has been weaponized for intimidation, and putting agents at concerts turns music into a surveillance zone. By staying out of the U.S. tour circuit, he’s protecting his audience from harassment.
 
Those tickets are too expensive for me, so I'll just pitch in my tax dollars to get ICE agents 50 yard line seats.
