The American Civil Liberties Union is suing the federal government on their behalf and will be in court Tuesday in Boston seeking a preliminary injunction, which would put the policy on hold while the lawsuit proceeds in court.’

Well .. it's because there are only two sexes, and you don't magically become the opposite sex when you get your crotch rearranged (as your article states: "it rejects the idea that someone can transition ..."). Makes perfect sense for the government to utilize what science has been telling us for thousands of years.

I guess the trannies would rather people look up their dresses or drop their pants in order to see what sex they are. I'd think it would just be easier to list your gender on your passport instead.
