Just to be clear, when this particular discussion speaks to "The HAMAS Charter," what is really under examination is The Covenant of the Islamic Resistance Movement (HAMAS), issued on August 18, 1988, and "The Position Paper" on the
General Principles and Policies of HAMAS, May 2017.

I see no reason to question the intent that the Hostile Arab Palestinians (HoAP) when they establish the following as Principles and Policies:
â—ˆ no matter how long the occupation lasts
â—ˆ land of Palestine shall be compromised or conceded
â—ˆ Hamas rejects all the agreements, initiatives and settlement projects that are aimed at undermining the Palestinian cause
â—ˆ Resisting the occupation with all means and methods is a legitimate right guaranteed by divine laws
â—ˆ Hamas rejects any attempt to undermine the resistance and its arms
â—ˆ Armed resistance, which is regarded as the strategic choice for protecting the principles and the rights of the Palestinian people.
Without regard to what the HoAP may say is lawful under international law, they cannot cite that law. Why, because these concepts behind 1) "all means and methods" and 2) "Armed Resistance" Are in violation of International Humanitarian Law and the International Covenant for Civil and Political Rights.

â—ˆ Advocacy of national, racial or religious hatred that constitutes incitement to discrimination, hostility or violence shall be prohibited by law
â—ˆ Protected persons who commit an offence intended to harm the Occupying Power, damage the property of the occupying forces or administration or the installations used by them, shall be liable to internment or simple imprisonment
Without regard to what the HoAP may say, no territory in the region was, by a matter of law, Occupied Palestinian Territory until after December 2012.

Many, many Anti-Israeli and Pro-Palestinian Jihadist, Fedayeen Activist, Hostile Insurgents, Radicalized Islamic Followers, and Asymmetric Fighters often imply that there is some actual "binding" resolution or "international law" that allows the HoAP the right of engaging in a Non-International Armed Conflict (NAIC). But you will never actually get them to cite such a "binding" resolution or "international law." In fact, the true nature of the law states the exact opposite.
