None of the charges involved the documents that he finally gave back. If he had obeyed the subpoena, he would have been clear. But his ego overcame his reason. The man is a Moron. He bought this all on himself.
They were going to persue this regardless. It was all about the method used to retrieve the documents (evidence) and the narrative presented based on the method used. They would have preferred to not use a raid (at least those with half a brain who understand the optics), but, the were pursuing this regardless. That may or not be problematic depending on how this plays out in the courts.

Did the DOJ charge Pence? Did they raid Biden's garage? No....if trump had given back the documents when asked, no one would have heard about it. But trump decided to hide, move, conceal and Lie about the documents.
Blame? His polls are going up and he's raising record amounts of campaign funds.
Of course the didn't do that. Did they charge Hillary Clinton?
Of course they were persuing top secret documents. All trump had to do was give them back, and none of this shit would have happened. Trump thinks laws don't apply to him.
