The Republicans keep missing opportunities to help the American people, and it is because they allow all the traction of the narrative to be on ICE enforcement.
So imagine the news cycle if Clarence Thomas announced his retirement and the Deputy USAG released the deep list of Judicial qualifited to fill the 42 open Federal Seats.
Suddenly, the Senate would be laser-focused on the ratification process of vetting Judicial nominees.

There are currently 42 vacant federal judicial seats in the federal judiciary, according to the official U.S. Courts vacancy table updated as of January 31, 2026.[uscourts]
If you focus only on the 870 Article III judgeships (Supreme Court, courts of appeals, district courts, Court of International Trade), that count is reported as 39 current vacancies by the American Constitution Society’s running tally.[acslaw]
