SCHEDULES: Will Stormy Daniels hush money case be Trump’s 1st criminal trial?

Yes...

But New York can't charge federal campaign violations against FPOTUS#45. The Fed's did charge Cohen, which is the underlying crime. New York has no jurisdiction to charge federal law, but they DO have jurisdiction to charge New York State business law where records were falsified to hide Cohens actions.

records that were stuck in a file cabinet at the corporation? Really

Given the voluminous number of criminal charges that multiply-indicted former president Donald Trump is facing, figuring out which prosecutor gets first dibs has been a bit of a guessing game.

The three main criminal prosecutions against Trump are his classified documents case in Florida, his election interference case in Washington DC, and the Stormy Daniels hush money case in New York, where Trump is accused of falsifying documents to cover up his payments.

While Special Counsel Jack Smith is overseeing the prosecution of the first two of these cases, Manhattan District Attorney Alvin Bragg is in charge of the hush money prosecution — which is essentially an election interference case because Trump likely sought to hide his payments to Daniels to avoid tanking his 2016 election chances.

D.A. Bragg has long expected to defer to the primacy of the federal prosecutions in setting his trial dates, but now, due to a number of factors, it unexpectedly looks like his case may be the first criminal trial to actually commence.

Yep, it looks like the Stormy Daniels hush money case may be Trump's 1st criminal trial. What do you think?
I believe so. It's also the weakest of all 4 cases.

Judge Rejects Trump's Attempt To Delay Hush Money Trial

Trump's Hush Money Case Is Set For Trial April 15.

NEW YORK (AP) — A New York judge has scheduled an April 15 trial date in former President Donald Trump’s hush money case.

Judge Juan M. Merchan made the ruling Monday. The judge earlier had scolded the former president’s lawyers as he weighed when to reschedule the trial after a last-minute document dump caused a postponement of the original date.

Merchan had bristled at what he suggested were baseless defense claims of “prosecutorial misconduct,” appearing unpersuaded by Trump team arguments that prosecutors had until recently concealed tens of thousands of pages of records from a previous federal investigation.

For those who missed today's news it will start of April 15.

Bragg does not have to prove there were violations of federal or state campaign finance law. He has to show there was a falsification of business records in an attempt to conceal or commit another crime. The crime for which Mike Cohen went to jail.

Robert Khuzami, Attorney for the United States, Acting Under Authority Conferred by 28 U.S.C. § 515, announced that MICHAEL COHEN was sentenced today to three years in prison for tax evasion, making false statements to a federally insured bank, and campaign finance violations. COHEN pled guilty on August 21, 2018, to an eight-count information before U.S. District Judge William H. Pauley III, who imposed today’s sentence. In a separate prosecution brought by the Special Counsel’s Office (“SCO”), COHEN pled guilty on November 29, 2018 to one count of making false statements to the U.S. Congress and was also sentenced on that case today, receiving a two-month concurrent sentence.
Michael Cohen Sentenced To 3 Years In Prison

I think it's unfortunate, given the seriousness of the other indictments, that this will be trial #1. However, it is the first criminal trial of a former US prez in US history so Don has once again distinguished himself. How proud his dad would be if he were still alive.

The reaction, or lack thereof, by The Following to Trump's admission on tape that he sexually assaulted women...........and laughed about it..........was the first inkling nothing he could do or say would affect the cult's devotion.

Which crime was that?
Not declaring an NDA as a campaign contribution?

"Not declaring an NDA as a campaign contribution?"

No.

Not declaring the $130,000 he paid out of his personal funds to pay the porn star that FPOTUS#45 boinked just days before the election to kill the story as a campaign contribution.

You know that a story about a Presidential candidate boinking a porn star while his 3rd wife was at home having just given birth to his son would be big news. Hmmm - well I guess him boinking a porn star on his 3rd wife, who he boinked will still married to his second wife, come to think of it he was boinking his second wife while married to his first wife.

Hell, no one would have been surprised, Trump/Cohen/Campaign should have just let the story come out. The reaction would have been "Ops Normal".

It wasn't a campaign contribution.

The checks to pay Cohen were issued through the Trump Organization. They were invoiced and paid as attorney fees, which are tax deductable. However such invoices were fraudulent as they were not attorney fee's.

They were reimbursement for paying for the NDA with Daniels, however the cost of the NDA is not tax deductible. Cohen committed and much later pled guilty to a federal crime, FPOTUS#45 falsified business records (willful intent) to aid and conceal Cohen's illegal activities. In so doing, his own actions were illegal.

Now, if FPOTUS#45 had just paid for the NDA directly there would have been no crime, then had Cohen made the arrangements, there would have been no crime. However in attempt to conceal it it resulted in illegal activity by both Cohen and FPOTUS#45.

Are you saying it is a crime to pay one's bills based on an earlier agreement? Oh, really. <wah-wah trumpet>

Where does it say NDAs aren't tax deductible? When is the IRS charging Trump?

Paying the porn star to keep quiet is a personal expense which is not tax deductible.

When FPOTUS#45 paid Cohen after the election to reimburse his criminal campaign contribution (yes it was criminal, he was convicted and went to jail), the reimbursement was paid by the Trump Organization as "Attorney's Fees". If FPOTUS#45 had paid Cohen out of personal funds there would have been no issue. However he attempted to coverup the payment and paid using business funds billed as "Attorney's Fees" which could be claimed as a business expense with no tax. Hence the charge in New York for falsifying business records.

Someone once said - and I paraphrase - it's not the crime that gets you, it's the coverup.
