The left has been discriminating against white men in government for jobs for years now. It's nothing new. A similar case is going through litigation in Cincinnati. One of the criticisms of Sonia Sotomayor during her confirmation was that she ruled against white firefighters in New Haven, CT who were denied promotions because not enough minorities passed the same exam to qualify them.

The plaintiffs include Lieutenants Christopher Bloom, Kollin Berg and Joseph Musumeci, as well as Sergeants Marc Monachello and LeRoy Ziegler Jr., all of whom are White males. The class-action lawsuit alleges that in November 2025, the five officers were denied promotions because of their race and sex due to the city's "Rule of Five" policy.

"The City of Philadelphia has adopted a Diversity, Equity, and Inclusion (DEI) promotion policy that it calls the 'Rule of Five,' which was instituted for the express purpose of increasing the representation of minority and female candidates in supervisory positions within the City of Philadelphia at the expense of white men," the lawsuit reads.

For decades, Philadelphia had used the "Rule of Two," which mandated appointing authorities to choose between the top two candidates on the civil-service eligibility list for promotions. The practice ended in 2021 when the city adopted its "Varying Rule" policy, commonly known as the "Rule of Five," which gives the appointing authorities the ability to choose from a larger pool of candidates.


What they adopted is the rule of "Can't Make it on Merit". DEI is a handout policy that pushes the unqualified people up the ladder. Eventually those unqualified people start making bad decisions that degrade the organization. It disincentivizes the qualified individuals who are the best for promotions. If you are just going to get passed over for someone who isn't qualified to carry your tools, why do any more than the bare minimum? Having others take credit for your work gets old real fast.

Actually, I should have said that she dissented. They won their case at the circuit court, but she was one of two who wrote a dissenting opinion.

Can't make it on merit is what you are pushing by opposing DEI. White ae not always the best qualified for jobs or promotions, so just because whites aen't getting pomoted don't mean the person who is was unqualified. Stop making this racist argument. For years there have been non-whites who trained whites who were promoted above them, and that's what you want to return America to by adopting this false argument.

SCOTUS is the final arbiter of the law.
 
What you call DEI whites have been getting for 250 years now.
I was hired in a steel mill because my father worked there and he was hired because he wasn`t Black and those were the best jobs in the Allegheny Valley. On and on it goes. The most racist person I`ve known was a high school special ed teacher who wasn`t as smart as 80% of my fellow steelworkers.

Up to the true DEI push and enactment of policy, the argument for decades was between African American and White in leadership positions as for the more dangerous work like police and fire fighting. There may have been and could be some DEI in that. At least when the integration started. However, it is nothing like now. Cities that have female police and fire commissioners are near pure DEI. With a fair percentage of them lesbians. When we see on TV any speaking at an even that happens, the men behind them in lower positions must be seething if they are not DEI. Your agendas have gone way to far as you jettisoned common sense.
