A few days ago, local officials in a county in Oregon ignored an ICE detainer and released on bail an illegal alien who had killed a woman and injured her husband while driving recklessly. Law enforcement officials in Washington County ignored an ICE detainer on Maldonado-Hernandez and released him on bail, even though he was a clear flight risk and even though he was charged with felony manslaughter in the second degree, felony assault in the third degree, and misdemeanor reckless driving. He then fled to Mexico to avoid prosecution. Needless to say, the victim's family is outraged.
Washington County officials are falsely claiming that they could not honor the ICE detainer because of a 2014 federal court decision that said that counties cannot hold people beyond their release date, even if they're illegal aliens. This is a bogus excuse. ICE detainers do not require local officials to hold someone beyond their release date: an ICE detainer simply directs that local law enforcement notify ICE in advance of a suspect's release so that ICE can take the person into custody when they're released. Local law enforcement does not have to hold a suspect one second beyond their scheduled release to honor an ICE detainer.
The refusal of some liberal-run counties to honor ICE detainers is dangerous lawlessness. Federal marshals should start arresting every local official who is involved with refusing to honor ICE detainers, and those officials should be charged with obstruction of justice and aiding in the violation of bond releases, at a minimum.
