The goal would be to then release more information to the FBI now that they have an open investigation. The group also indicates that they have ownership of Hillary’s 33,000 deleted emails and will be releasing those soon, as well.

As the hacker states in the above chat, “we are purposely holding them back so that the Democratic Party does not have time to replace Hillary Clinton.”

Hardly. The FBI's future does not depend on who wins the election. It's going to "be there" and serving the American people no matter who wins.

The server was not itself illegal. That Mrs. Clinton used a personal server was not an illegal act. That Mrs. Clinton sent/received classified information via the server is an illegal act (actus rea); however, it's not criminally prosecutable (that is, she's not criminally culpable) under Section 793(f) until there is found convincing (in a courtroom, not in the "court of public opinion") evidence that she intended (mens rea) to circumvent/violate the provisions of 793(f) and using a personal email server/account was the means by which she sought to act upon that intent.

If a person steps (unintentionally) in front of your car that you were driving at a speed in excess of the posted speed limit, are you criminally culpable because you were speeding when the calamity happened? No, of course not, even though you clearly had wanton disregard for at least one law. Did you in fact kill the person? Yes. Is killing a person a crime? Yes. Are you criminally culpable because you killed the person? No. You are not because you had no intention of killing them. That's just one illustration of how actus rea and mens rea work in our jurisprudential system, and while that example is an extreme one, the concepts are applied to matters great and small.

As for the email(s) that has (have) come to light most recently, well, it/they may or may not provide convincing (to a criminal trial standard, not that needed in the "court of public opinion") evidence of intent. If it does, then fine, by all means, Mrs. Clinton should be charged. Do I get to make the decision about what constitutes "convincing evidence?" No, neither do the millions of other folks who follow the matter.

I am of a similar mind about whether Donald Trump should be (or should have been) charged with third degree sexual assault which, unlike 793(f) violations (per SCOTUS' Gorin decision), is a strict liability crime. It's very hard for me to conceive that he knows/knew he could, unbidden, kiss and/or grope women's genitals (sexually assault them) without his at least having done so on multiple occasions. All the same, though I personally would just as soon see him charged for that, I have not advocated that he actually be charged. The only reason I have not done so is because what's come out in public doesn't go beyond the level of "common sense" reasoning I just shared. That line of reasoning, however sensible it be, is not going to stand up in a criminal trial. The same is apparently, based on Dir. Comey's July 2016 remarks, so of what the FBI found on Mrs. Clinton's server.

Is it clear to you that his avatar is anything other than a graphical sardonic expression of how he perceives Donald Trump? It's certainly not clear to me. The avatar strikes me as ambiguous in nature insofar as the image of "commander Trump" could be taken in multiple ways. I don't know of JimBowie1958's having articulated his intent for using the avatar he does.

That image conveys the same ambiguity as does JimBowie1958's avatar image. I'm not sure what to make of that image for it's not clear to me just what angel Trump is being equated to. IIRC from my art history classes:
  • Red/coppery tones --> Alludes to Gabriel
  • Sword --> Alludes to Uriel, although it's in the wrong hand as Uriel was, in classical imagery, dextral.
  • Warrior's garb --> Alludes to Michael
  • Green tones --> Alludes to Raphael
Christianity is big on the "three for one" deal, but I'm not aware of that applying to archangels.

It is kind of a joke, but I do admire many of the mans traits. While I can think of about five people I would have preferred over Trump (Paul, Webb, Sanders, Cruz, and Carson) I want someone right now who will "drain the swamp".

Well, that just goes to show how different folks take different things from imagery. Jim's avatar evokes Napoleon for me, and that tyrant is among the last folks whose memory and bearing I'd deliberately evoke were I keen on Trump.

Whether or not Napoleon saved or suppressed the progress made from the French Revolution is debatable. If his ego and personal agenda had not overtaken him, he may very well have been one of France’s greatest revolutionary leaders ever (in sustaining its principles that is). In the end, Napoleon was regarded by most all of Europe as a dictator and tyrant. It is hard to say he aided revolutionary idea progress when he himself abolished many of its principles and reestablished a monarchy himself.

That is presumptive. Many institutions have a long held contempt for them by the public, like the ATFE. And just as that inglorious institution might one day be defunded and cannibalized, the same could happen to the FBI if its reputation gets similarly dismantled by scandal and contempt.

I don't mind "draining the swamp," but filling it with "different water" still gives one a swamp and when one builds something on swampland, the "reclaimed" land is nonetheless prone to being filled with "bad water" and the structures there have to continually monitored for leaks, cracks, shifting and sinking.
