They believed he had the gun, as they saw it in his hand and did not see him drop it (as he clearly did so in a manner to conceal it from the officer). So no, they weren't lying. They made an error, which is understandable given the speed at which he turned and raised his arm. So saying they lied is the lie, and you just told it.

And tjey had no time to see he was unarmed. Unless you would like to suggest the officers should wait until it is clear that he doesn't have a gun pointed at them ready to shoot, before shooting. Which is an impossible ask. We cannot expect cops to "wait to see if they are shot or not".
 
In that scenario, that kid gets shot 100% of the time by the police. Every time. The police cannot wait to see if someone has dropped their gun, when they raise up that quickly. That is too much too ask of them.

His parents failed him. What was a 13 year old seventh grader doing out on the street at 2:30 in the morning (on a school night) with a gun and another adult? I think mom and dad bear some responsibility for their negligence. As a parent, I would feel totally responsible if my grade school son was playing thug with guns on the street.
