State v. Keller, the court ruled that spitting constituted assault because it involved an intentional act that was offensive and provocative.

Felony assault charges can result in fines up to $5,000 and several years of imprisonment. The nature of the act, the intent, and the societal role of the victim often determine the degree of the charge and the corresponding penalties.


Hate crime laws include crimes committed on the basis of the victim’s perceived or actual race, color, religion, national origin, sexual orientation, gender, gender identity, or disability.


What this man did was IMHO, aggravated assault. Now, throw in that his victims were chosen by him on the basis of race, that makes them by definition a Hate crime, with its added penalties...Now, should he have been released? I would hope not, especially with his prior crimes, however, for some strange reason, we have the courts in our country seemingly taking the side of the criminals over that of the law abiding citizens.

Almost ANY crimes in NYC or LA are out on cashless Bail as far as I know.

Maybe violent felonies (bloody hospitalized or dead victims) require overnight stay in the holding tank to look into charges?

A salivating sicko was busted last week in a racially-motivated spitting spree that targeted four white women in Williamsburg, Brooklyn — but walked free a day later, The Post has learned.

Anthony Caines, who is black, was arrested Nov. 13 after his repulsive two-day spitfest, but was sprung on Nov. 14 after pleading not guilty on charges including aggravated harassment based on race or religion, according to court documents obtained by The Post.

Caines, 45, whose rap sheet include arrests for domestic violence and contempt of court, was granted supervised release, authorities said."





Hobbes wrote of the social contract that the state has with the people. The people give up their right to retribution, if the state administers justice fairly.
The state is breaking that contract on a daily basis in large Democrat cities and counties by releasing dangerous people back on the streets prior to prosecution and
punishment. In fact, there is no real punishment anymore for those who do not seem to mind being warehoused in a prison. People with the means are fleeing these Democrat urban areas.
Eventually, the criminality creeps out to the inner suburbs. What happens when people can no longer afford to flee from the criminals and their political protectors?
I'm sure there will be at least one mention of Emit Till. Oh and a 1930s picture of a lynching.

He took a beating on the street from a couple of unidentified guys.


This raises the issue of vigilante “justice” on the streets. And I think that topic is worth a quick mention.

When we have an agreement with the government that the government will take on the role of public protectors via police, prosecutors and the criminal justice system BUT the government has largely ceased doing that job, what follows?

Do we become helpless victims of the criminals?

Or, by chance, are we therefore obliged to engage in societal self-defense outside of cops, prosecutors and the criminal justice system?

I am no fan of vigilantism. But I am also no fan of relying on any local government which has effectively abdicated its job in this area.
 
Supervised release means he was not released free.
Sort of. It means that the defendant doesn’t have to post bail or a bail bond to be out of jail pending trial. So such a defendant is released. And he often is free. But first he has to be interviewed by an agency staffed by social workers.

These social workers try to keep in contact with the defendants obtaining address and phone contact information, work phones and addresses where they are employed and even familial contact information.

The defendants get appointments scheduled to come in for “meetings,” once a week or once a month.

It allows the accused to be free (ie, out of jail) pending trial in a way designed to make sure he comes back to court as scheduled and when scheduled.
Now one can argue whether or not that should happen but I guess this is another example of false news.
It isn’t always available. And on a case by case basis sometimes (under the law or the allegations of the alleged crime) it is a terrible decision for a judge to grant it. But, sometimes, denying it is also unfair.
