Doesn't matter. It greatly increases the power of the Executive branch, which over the last few decades has already vastly accumulated more latitude outside our systems of checks and balances.

Any spending measures he takes with the emergency declaration has a check, Congress can override it if they wish.

Calling people off the IRR is not even the same ballpark and it isn't cherrypicking to say the SCOTUS has ruled on the issue of emergency powers already.
